利用規約

この利用規約（以下「本規約」）は、運営者が提供するiOSアプリ「Loop Workout」（以下「本アプリ」）の利用条件を定めるものです。本アプリをダウンロードまたはご利用いただくことで、本規約に同意したものとみなします。

本アプリをインストールまたは使用することで、ユーザーは本規約に同意したものとみなします。本規約に同意いただけない場合は、本アプリをご利用いただけません。なお、本アプリはAppleのApp Storeを通じて配信されており、AppleのApp Store利用規約（標準エンドユーザーライセンス契約等を含む）も適用されます。本規約はその補足的な利用条件を定めるものです。

本アプリは、ユーザーが任意の運動や活動を項目として登録し、その実施状況を記録・確認するための補助ツールです。筋力トレーニングに限らず、ストレッチ、柔軟運動、ランニング、体幹トレーニング、スポーツ練習など、幅広い活動の記録にご利用いただけます。

本アプリは、運動の実施、継続、成果、または健康改善を保証するものではありません。

本アプリはiOS端末での個人的な利用を想定しています。商業目的での再配布、サブライセンス、または本規約に定める禁止事項に該当する利用はできません。

以下の行為を禁止します。

• –法令または公序良俗に反する利用
• –本アプリまたは第三者の知的財産権その他の権利を侵害する利用
• –リバースエンジニアリング、逆コンパイル、逆アセンブル等（適用法令により認められる場合を除く）
• –本アプリのセキュリティ機能や購入制限を回避する行為
• –不正な購入または不正な購入状態を作出する行為
• –本アプリの正常な動作を妨害する行為
• –マルウェアや有害なデータを読み込ませる行為
• –他者になりすます行為
• –本アプリを違法、有害または危険な目的で利用する行為

ユーザーが本アプリに登録するワークアウト項目名、実施日、実施状況、その他の入力情報は、ユーザー自身が管理します。機密情報や必要以上に詳細な健康情報をアプリ内に入力することはお控えください。

ユーザーが登録したワークアウト項目や実施記録は、原則としてユーザーのiPhone内に保存されます。運営者はこれらのデータを独自サーバーへ送信または保管しておらず、ユーザーの端末内記録を閲覧、修正、または復元することはできません。

本アプリは、運営者独自のクラウド同期機能や自動バックアップ機能を提供していません。アプリの削除、端末の故障・紛失・初期化、OSの更新・不具合、誤操作等により、データが失われる可能性があります。

本アプリのエクスポート機能は、データを書き出すための補助的な機能です。エクスポートファイルが将来インポート可能であること、またはバックアップ、復元もしくは機種変更時の移行手段として継続的に利用できることを保証するものではありません。重要な情報については、本アプリ内のデータまたはエクスポートファイルのみを唯一の保存手段としないでください。

データが失われた場合、運営者は原則として復元することができません。

本アプリのエクスポートおよびインポート機能は、データの書き出しおよび読込みを補助する機能です。エクスポートされたファイルの保存、共有および管理は、ユーザー自身の責任で行ってください。

インポートの可否および結果は、ファイルの内容、作成時のアプリバージョン、現在のアプリバージョン、iOSのバージョン、端末の状態、ファイルの保存先、ファイル管理サービスその他の利用環境により異なる場合があります。

運営者は、以下を保証しません。

• –過去に本アプリから正常にエクスポートされたファイルを、将来のバージョンでインポートできること
• –すべてのiOSバージョン、端末および利用環境でインポートが成功すること
• –インポートによってすべてのデータが完全かつ正確に復元または移行されること
• –エクスポートファイルの形式および互換性が将来にわたり維持されること
• –破損、改変、欠損、古い形式または互換性のないファイルが正常に処理されること

インポートによって、既存データが追加、変更、重複、上書きまたは失われる場合があります。インポートを行う前に、現在のデータおよび対象ファイルの内容をユーザー自身で確認してください。

運営者は、個別のエクスポートファイルの解析、修復、変換、復旧、手動移行、または個別の端末・OS・利用環境に合わせた互換対応を行う義務を負いません。

本アプリはローカル通知機能を提供しますが、通知が常に指定した日時に届くことを保証しません。iOSの仕様、端末の状態、集中モード設定等により、通知が届かない場合や遅延する場合があります。通知が届かなかったことによる運動未実施等について、運営者は責任を負いません。

無料版では、ワークアウト項目を3項目まで登録できます。4項目目以降を登録するには、買い切り購入による利用制限の解除が必要です。

本アプリには、利用制限を解除するための買い切り型のアプリ内購入があります。これは一度限りの購入であり、サブスクリプション（定期課金）ではありません。

• –購入はAppleのApp StoreおよびStoreKitを通じて処理されます
• –実際の価格はApp Storeに表示される価格に従います
• –税金や通貨換算を含む表示・請求はAppleの仕組みに従います
• –購入はユーザーのApple IDに関連付けられます
• –運営者はApple IDや決済情報へアクセスすることはできません

以前に購入した場合は、アプリ内の機能から購入を復元することができます。購入の復元はAppleの購入履歴およびStoreKitの仕組みに依存します。復元には購入時と同じApple IDでサインインしている必要があります。通信環境、地域、Apple側の状態等によっては復元できない場合があります。復元できない場合は、App StoreのサポートおよびAppleの購入履歴もあわせてご確認ください。ファミリー共有への対応については、Appleの条件および本アプリの実装によります。

返金の可否および手続はAppleの規約・判断に従います。返金を希望する場合は、Appleの公式サポートを通じて手続してください。運営者へメールを送るだけでは返金申請にはなりません。運営者が直接返金処理を行うことはありません。

本アプリは医療機器ではなく、医療、診断、治療、予防、リハビリテーション指導、栄養指導、または健康指導を提供するサービスではありません。アプリ内の表示や通知は、医師その他の専門家の助言に代わるものではありません。

本アプリを利用して運動を行う際は、以下の点に注意してください。

• –運動を始めるか、続けるか、内容や強度をどうするかは、ご自身でご判断ください
• –持病、怪我、妊娠、服薬、運動制限その他の不安がある場合は、事前に医師等の専門家へご相談ください
• –痛み、めまい、胸部の不快感、息苦しさ、吐き気、意識の異常その他の体調不良を感じた場合は、直ちに運動を中止し、必要に応じて医療機関等へご相談ください
• –周囲の安全、器具の状態、服装、環境、天候、交通状況等をご確認のうえご利用ください
• –自動車、自転車、機械等を操作しながら本アプリを操作しないでください

本アプリの利用はユーザー自身の判断と責任において行ってください。本アプリを通じた運動中の怪我、事故、体調悪化、その他の損害について、運営者は法令上許される範囲で責任を負いません。

運営者は、法令上必要な場合を除き、事前通知なく本アプリの内容を変更することがあります。OS、App Store、またはAppleの仕様変更等により、一部の機能が変更または利用できなくなる可能性があります。保守、障害対応、セキュリティ上の理由等により、本アプリの提供を一時的に停止することがあります。

運営者は将来にわたる本アプリの提供を保証しません。本アプリの提供を終了する場合でも、個別のデータ移行や復元、またはエクスポート・インポート形式の互換対応を保証するものではなく、個別ファイルの変換や手動移行を行う義務も負いません。ただし、法令上必要な対応は行います。有料購入者の正当な権利を不当に侵害するような対応は行いません。

本アプリに関する知的財産権は運営者または正当な権利者に帰属します。本規約は、本アプリを本規約の範囲内でご利用いただくためのライセンスを付与するものであり、それ以外の権利を付与するものではありません。

本アプリはAppleのApp Store、StoreKit等のサービスを利用しています。これらのサービスにはAppleの利用規約およびプライバシーポリシーが適用されます。運営者はAppleのサービスの内容・可用性・変更について責任を負いません。

本アプリは「現状有姿」かつ「提供可能な範囲」で提供されます。運営者は、法令上許される範囲において、以下を保証しません。

• –本アプリの正確性、完全性、有用性、特定目的への適合性
• –継続的・無停止での提供、またはエラーがないこと
• –すべてのiPhone機種、iOSバージョン、地域、設定での動作
• –通知が指定した日時に必ず届くこと
• –購入の復元が常に成功すること
• –データが失われないこと
• –エクスポートファイルが将来のバージョンでインポートできること
• –インポートまたはデータ移行が完全かつ正確に成功すること

運営者の故意または重過失による場合を除き、法令上許される範囲において、間接損害、特別損害、付随的損害、結果的損害、逸失利益、データ消失等について運営者は責任を負いません。

法令上許される範囲で、運営者の責任は現実に発生した直接かつ通常の損害に限定されます。またユーザーが本アプリについて実際に支払った金額を超える損害賠償責任を、法令上許される範囲で負わないものとします。ただし、適用法令によりこの制限が認められない場合には適用されません。

消費者契約法その他の強行法規により免責または制限できない責任については、本条の適用を受けません。

本規約を変更する場合は、変更後の規約を本ページに掲載することにより通知します。変更後の規約は本ページへの掲載時点で効力を生じます。引き続き本アプリをご利用いただくことで、変更後の規約に同意したものとみなします。

本規約のいずれかの条項が無効または執行不能と判断された場合でも、残りの条項は引き続き有効に存続します。

運営者が本規約の条項を一時的に行使しない場合でも、当該条項に関する権利を放棄したものとみなされません。

ユーザーは、運営者の事前の書面による同意なく、本規約上の権利または義務を第三者へ譲渡することはできません。運営者は、合併、事業譲渡等の場合に本規約上の権利義務を第三者へ移転することがあります。

本規約は日本法に準拠します。本規約に関する紛争については、法令上許される範囲で、東京地方裁判所または東京簡易裁判所を第一審の専属的合意管轄裁判所とします。ただし、ユーザーの居住地に適用される強行的な消費者保護法上の権利はこれによって排除されません。

These Terms of Use ("Terms") govern your use of the iOS app "Loop Workout" ("the App") provided by the developer. By downloading or using the App, you agree to these Terms.

By installing or using the App, you agree to these Terms. If you do not agree, please do not use the App. The App is distributed through the Apple App Store, and Apple's terms of service (including the standard end user license agreement) also apply. These Terms set out supplemental conditions specific to Loop Workout.

Loop Workout is a tool to help you log and review workouts and physical activities. You can record any type of activity — not only strength training, but also stretching, flexibility exercises, running, core training, sports practice, and more.

The App does not guarantee that you will exercise, stay consistent, achieve specific results, or improve your health.

The App is intended for personal use on iOS devices. Redistribution, sublicensing, or use in ways that violate these Terms is not permitted.

The following are prohibited:

• –Using the App in violation of applicable laws or public order
• –Infringing on the intellectual property or other rights of the developer or third parties
• –Reverse engineering, decompiling, or disassembling the App, except as permitted by applicable law
• –Circumventing security features or purchase restrictions in the App
• –Creating fraudulent purchases or fraudulent purchase states
• –Interfering with the normal operation of the App
• –Loading malware or harmful data into the App
• –Impersonating another person
• –Using the App for any illegal, harmful, or dangerous purpose

You are responsible for the workout names, dates, notes, and other content you enter in the App. We recommend that you do not enter confidential information or more detailed health information than necessary.

Workout items and activity records are stored on your iPhone. We do not transmit this data to our own servers and cannot view, modify, or restore data stored on your device.

Loop Workout does not offer its own cloud sync or automatic backup service. Data may be lost due to app deletion, device failure, loss, factory reset, OS updates or issues, or accidental actions.

The export feature is a supplementary function for writing data to a file. We do not guarantee that exported files will remain importable in the future or continue to function as a backup, restoration, or device-migration method. Do not rely on data stored in the App or exported files as the sole means of preserving important information.

We cannot restore data that we do not hold.

The App's export and import features are supplementary functions for writing and reading data. You are responsible for storing, sharing, and managing exported files.

Whether an import is possible and the result of an import may vary depending on the file contents, the App version used to create the file, the current App version, the iOS version, device condition, file storage location, file-management service, and other aspects of the user's environment.

We do not guarantee:

• –That a file previously exported successfully from the App will remain importable in a future version
• –That imports will succeed on every iOS version, device, or user environment
• –That all data will be restored or migrated completely and accurately
• –That export-file formats and compatibility will be maintained indefinitely
• –That corrupted, modified, incomplete, outdated, or incompatible files will be processed successfully

Importing may add, modify, duplicate, overwrite, or remove existing data. Before importing, you are responsible for reviewing your current data and the contents of the file you intend to import.

We are not obligated to inspect, repair, convert, recover, or manually migrate individual export files, or to provide compatibility support tailored to a specific device, operating-system version, or user environment.

Loop Workout provides local notifications, but we cannot guarantee that notifications will always arrive at the exact scheduled time. Delays or failures may occur due to iOS behavior, device status, Focus Mode, or other factors. We are not responsible for missed workouts or other consequences resulting from undelivered notifications.

The free version allows you to create up to three workout items. A one-time purchase is required to create a fourth item or any additional items.

The App includes a one-time in-app purchase to unlock the item limit. This is a one-time charge, not a subscription.

• –All purchases are processed by Apple through the App Store and StoreKit
• –The price shown in the App Store applies
• –Taxes and currency conversions are handled by Apple
• –Purchases are associated with your Apple ID
• –We do not have access to your Apple ID or payment information

If you have previously purchased the unlock, you can restore it from within the App. Restoration depends on Apple's purchase history and StoreKit. You must be signed in with the same Apple ID used for the original purchase. Restoration may not succeed in all cases due to network conditions, regional settings, or other factors on Apple's end. If restoration fails, please also check Apple's purchase history and App Store support. Availability of Family Sharing depends on Apple's terms and the app's implementation.

Refund eligibility and procedures are determined by Apple's policies. To request a refund, please use Apple's official support channels. Sending an email to us does not constitute a refund request, and we do not process refunds directly.

The App is not a medical device and does not provide medical advice, diagnosis, treatment, prevention, rehabilitation guidance, nutritional guidance, or health counseling. Nothing in the App is a substitute for advice from a doctor or other qualified professional.

When using the App for exercise, please:

• –Decide for yourself whether to start, continue, or adjust your exercise routine
• –Consult a doctor or specialist before starting if you have any health conditions, injuries, pregnancy, medications, movement restrictions, or other concerns
• –Stop exercising immediately and seek medical attention if you experience pain, dizziness, chest discomfort, shortness of breath, nausea, altered consciousness, or any other symptoms
• –Ensure your surroundings are safe and check the condition of any equipment before exercising
• –Do not use the App while operating a vehicle, bicycle, or machinery

Use of the App is at your own discretion and risk. To the extent permitted by applicable law, we are not liable for injuries, accidents, health deterioration, or other harm that may occur during exercise using the App.

We may update the App's content without prior notice, except where required by applicable law. Some features may change or become unavailable due to OS, App Store, or Apple platform updates. We may temporarily suspend the App for maintenance, outage response, or security purposes.

We do not guarantee continued availability of the App. If the App is discontinued, we do not guarantee data migration, restoration, or continued compatibility of export or import formats, and we are not obligated to convert individual files or perform manual migrations. We will comply with applicable legal obligations and will not unfairly prejudice the rights of users who have made purchases.

All intellectual property rights in the App belong to the developer or their respective rights holders. These Terms grant you a license to use the App within the scope of these Terms only, and do not transfer any other rights.

The App uses services provided by Apple, including the App Store and StoreKit. Apple's terms of service and privacy policy govern those services. We are not responsible for the content, availability, or changes to Apple's services.

The App is provided "as is" and "as available." To the extent permitted by applicable law, we do not warrant:

• –The accuracy, completeness, usefulness, or fitness for a particular purpose of the App
• –Continuous, uninterrupted operation, or that the App will be error-free
• –That the App will work on all iPhone models, iOS versions, regions, or configurations
• –That notifications will always arrive at the scheduled time
• –That purchase restoration will always succeed
• –That data will not be lost
• –That exported files will remain importable in future versions
• –That imports or data migrations will be completed successfully, completely, or accurately

Except in cases of our willful misconduct or gross negligence, to the extent permitted by applicable law, we are not liable for indirect, special, incidental, consequential, or punitive damages, lost profits, or data loss.

To the extent permitted by law, our total liability to you shall not exceed the amount you actually paid for the App. This limitation does not apply where it is not permitted under applicable law.

Nothing in these Terms limits liability that cannot be excluded or limited under mandatory consumer protection laws, including the Japanese Consumer Contract Act.

If we make changes to these Terms, we will post the updated version on this page. The updated Terms take effect when posted. Your continued use of the App after changes are posted constitutes your acceptance.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full effect.

Our failure to enforce any provision of these Terms at any time does not constitute a waiver of that provision.

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may transfer our rights and obligations in connection with a merger, acquisition, or similar transaction.

These Terms are governed by the laws of Japan. To the extent permitted by applicable law, disputes arising from these Terms shall be subject to the exclusive jurisdiction of the Tokyo District Court or Tokyo Summary Court as the court of first instance. This does not limit any mandatory consumer protection rights you may have under the laws of your place of residence.
