利用規約

この利用規約（以下「本規約」）は、運営者が提供するiOSアプリ「STASH」（以下「本アプリ」）の利用条件を定めるものです。本アプリをダウンロードまたはご利用いただくことで、本規約に同意したものとみなします。

本アプリをインストールまたは使用することで、ユーザーは本規約に同意したものとみなします。本規約に同意いただけない場合は、本アプリをご利用いただけません。なお、本アプリはAppleのApp Storeを通じて配信されており、AppleのApp Store利用規約（標準エンドユーザーライセンス契約等を含む）も適用されます。本規約はその補足的な利用条件を定めるものです。

STASHはダンサーのためのiPhone撮影アプリです。ポーズ操作を利用してスマートフォンから離れた場所でも撮影できる機能を提供します。主なモードは以下のとおりです。

• –STASHモード — 直前の一定時間を保存するローリング録画（無料）
• –RECORDモード — ポーズ操作で録画の開始・停止を行う通常撮影（STASH Pro）
• –CYPHERモード — 複数人がターンごとに交代するサイファー形式の撮影・分割保存（STASH Pro）

本アプリはiOS端末での個人的な利用を想定しています。商業目的での再配布、サブライセンス、または本規約に定める禁止事項に該当する利用はできません。

以下の行為を禁止します。

• –法令または公序良俗に反する利用
• –本アプリまたは第三者の知的財産権その他の権利を侵害する利用
• –リバースエンジニアリング、逆コンパイル、逆アセンブル等（適用法令により認められる場合を除く）
• –本アプリのセキュリティ機能や購入制限を回避する行為
• –不正な購入または不正な購入状態を作出する行為
• –本アプリの正常な動作を妨害する行為
• –マルウェアや有害なデータを読み込ませる行為
• –他者になりすます行為
• –本アプリを違法、有害または危険な目的で利用する行為
• –撮影する権利のない場所・人物・コンテンツを撮影する行為

本アプリを使用した撮影に関するすべての責任は、ユーザー自身が負います。撮影を行う際は、以下の点に注意してください。

• –撮影が許可されていない場所では撮影しないこと
• –他者を撮影する場合は、必要な同意を事前に得ること
• –著作権その他の権利が存在するコンテンツを、権利者の許可なく撮影・記録しないこと
• –プライバシーの侵害、名誉毀損その他の他者の権利を侵害する態様で撮影しないこと
• –各地の法令・施設ルール・マナー等に従って撮影を行うこと
• –撮影した動画の利用・共有・公開についても、適用される法令および第三者の権利に従うこと

撮影に際して第三者のプライバシー・肖像権・著作権等を侵害した場合、ユーザー自身が責任を負います。運営者はユーザーの撮影行為や動画の内容について責任を負いません。

本アプリを使用して他者を撮影する場合は、撮影される方のプライバシーおよび肖像権に十分配慮してください。第三者が映り込む可能性がある場合は、適切な同意を取得してください。撮影した動画を公開・共有する際も、映り込んだ第三者のプライバシーに配慮してください。

STASHモードは無料でご利用いただけます。ローリング録画機能を使用して、直前の映像をいつでも保存できます。

STASH ProはRECORDモードおよびCYPHERモードが利用できる自動更新サブスクリプションです。

STASH Proは自動更新サブスクリプションです。各更新期間の終了前にキャンセルしない限り、自動的に次の期間へ更新されます。更新の24時間以上前にキャンセルしない場合、次の期間分の料金が課金されます。

• –料金はApp Storeの購入画面に表示される金額に従います
• –Apple ID / App Storeを通じて課金されます
• –料金や提供条件は地域等によって異なる場合があります
• –更新やキャンセルはAppleのサブスクリプション管理（設定 → Apple ID → サブスクリプション）から行えます
• –キャンセルは現在の期間の終了まで有効であり、即時解約にはなりません
• –運営者はサブスクリプションの変更・解約を直接行うことはできません

対象ユーザーに対して、STASH Proの無料トライアル期間が提供される場合があります。提供の有無・期間・条件はApp Storeの購入画面でご確認ください。すべてのユーザーに無料トライアルが提供されることを保証するものではありません。

無料トライアル期間内にキャンセルしない場合、期間終了後は有料プランへ自動的に移行します。

STASH Proの購入はAppleのApp StoreおよびStoreKit 2を通じて処理されます。実際の料金はApp Storeに表示される金額をご確認ください。税金や通貨換算を含む表示・請求はAppleの仕組みに従います。運営者はApple IDや決済情報へアクセスすることはできません。

STASH Proのキャンセルは、iPhoneの「設定」→ お名前（Apple ID）→「サブスクリプション」から行えます。各更新期間の終了24時間前までにキャンセルすることで、次の期間への自動更新を停止できます。キャンセル後も、現在の期間が終了するまではSTASH Proをご利用いただけます。

返金の可否および手続はAppleの規約・判断に従います。返金を希望する場合は、Appleの公式サポートを通じて手続してください。運営者へメールを送るだけでは返金申請にはなりません。運営者が直接返金処理を行うことはありません。

本アプリで撮影した動画は端末内および写真ライブラリに保存されます。運営者はこれらのデータを独自サーバーへ送信または保管しておらず、ユーザーの端末内データを閲覧、修正、または復元することはできません。アプリの削除や端末の初期化等によりデータが失われた場合、運営者は復元できません。

本アプリに関する知的財産権は運営者または正当な権利者に帰属します。本規約は、本アプリを本規約の範囲内でご利用いただくためのライセンスを付与するものであり、それ以外の権利を付与するものではありません。

運営者は、法令上必要な場合を除き、事前通知なく本アプリの内容を変更することがあります。OS、App Store、またはAppleの仕様変更等により、一部の機能が変更または利用できなくなる可能性があります。保守、障害対応、セキュリティ上の理由等により、本アプリの提供を一時的に停止することがあります。

運営者は将来にわたる本アプリの提供を保証しません。本アプリの提供を終了する場合でも、個別のデータ移行や復元を保証するものではありません。ただし、法令上必要な対応は行います。有料購入者の正当な権利を不当に侵害するような対応は行いません。

本アプリはAppleのApp Store、StoreKit 2等のサービスを利用しています。これらのサービスにはAppleの利用規約およびプライバシーポリシーが適用されます。運営者はAppleのサービスの内容・可用性・変更について責任を負いません。

本アプリは「現状有姿」かつ「提供可能な範囲」で提供されます。運営者は、法令上許される範囲において、以下を保証しません。

• –本アプリの正確性、完全性、有用性、特定目的への適合性
• –継続的・無停止での提供、またはエラーがないこと
• –すべてのiPhone機種、iOSバージョン、地域、設定での動作
• –ポーズ検出が常に正確に動作すること
• –撮影した動画が常に正常に保存されること
• –購入の復元が常に成功すること

運営者の故意または重過失による場合を除き、法令上許される範囲において、間接損害、特別損害、付随的損害、結果的損害、逸失利益、データ消失等について運営者は責任を負いません。

法令上許される範囲で、運営者の責任は現実に発生した直接かつ通常の損害に限定されます。またユーザーが本アプリについて実際に支払った金額を超える損害賠償責任を、法令上許される範囲で負わないものとします。ただし、適用法令によりこの制限が認められない場合には適用されません。

消費者契約法その他の強行法規により免責または制限できない責任については、本条の適用を受けません。

本規約を変更する場合は、変更後の規約を本ページに掲載することにより通知します。変更後の規約は本ページへの掲載時点で効力を生じます。引き続き本アプリをご利用いただくことで、変更後の規約に同意したものとみなします。

本規約のいずれかの条項が無効または執行不能と判断された場合でも、残りの条項は引き続き有効に存続します。

運営者が本規約の条項を一時的に行使しない場合でも、当該条項に関する権利を放棄したものとみなされません。

ユーザーは、運営者の事前の書面による同意なく、本規約上の権利または義務を第三者へ譲渡することはできません。運営者は、合併、事業譲渡等の場合に本規約上の権利義務を第三者へ移転することがあります。

本規約は日本法に準拠します。本規約に関する紛争については、法令上許される範囲で、東京地方裁判所または東京簡易裁判所を第一審の専属的合意管轄裁判所とします。ただし、ユーザーの居住地に適用される強行的な消費者保護法上の権利はこれによって排除されません。

These Terms of Service ("Terms") govern your use of the iOS app "STASH" ("the App") provided by the developer. By downloading or using the App, you agree to these Terms.

By installing or using the App, you agree to these Terms. If you do not agree, please do not use the App. The App is distributed through the Apple App Store, and Apple's terms of service (including the standard end user license agreement) also apply. These Terms set out supplemental conditions specific to STASH.

STASH is an iPhone filming app for dancers. It lets you control recording with poses — even when you are away from your phone. The main modes are:

• –STASH Mode — Rolling recording that lets you save the most recent footage at any time (Free)
• –RECORD Mode — Standard filming with pose-based recording controls (STASH Pro)
• –CYPHER Mode — Cypher-style filming for multiple dancers taking turns, with automatic video splitting (STASH Pro)

The App is intended for personal use on iOS devices. Redistribution, sublicensing, or use in ways that violate these Terms is not permitted.

The following are prohibited:

• –Using the App in violation of applicable laws or public order
• –Infringing on the intellectual property or other rights of the developer or third parties
• –Reverse engineering, decompiling, or disassembling the App, except as permitted by applicable law
• –Circumventing security features or purchase restrictions in the App
• –Creating fraudulent purchases or fraudulent purchase states
• –Interfering with the normal operation of the App
• –Loading malware or harmful data into the App
• –Impersonating another person
• –Using the App for any illegal, harmful, or dangerous purpose
• –Filming locations, people, or content you do not have the right to film

You are solely responsible for how you use the App to film. When filming, please ensure that:

• –You do not film in locations where filming is not permitted
• –You obtain the necessary consent before filming other people
• –You do not record content protected by copyright or other rights without permission from the rights holder
• –You do not film in a way that violates anyone's privacy, defames others, or infringes on their rights
• –You comply with applicable laws, venue rules, and social norms
• –You use, share, and publish recorded videos in compliance with applicable law and the rights of others

If your filming violates the privacy, portrait rights, copyright, or other rights of third parties, you are responsible for such violations. We are not responsible for your filming activities or the content of your recordings.

When using the App to film other people, please give full consideration to their privacy and portrait rights. Obtain appropriate consent where others may appear on camera. When sharing or publishing recorded videos, be mindful of the privacy of anyone who may appear in the footage.

STASH Mode is available for free. The rolling recording feature lets you save the most recent footage at any time during a continuous recording session.

STASH Pro is an auto-renewing subscription that unlocks RECORD Mode and CYPHER Mode.

STASH Pro is an auto-renewing subscription. It will automatically renew at the end of each billing period unless you cancel at least 24 hours before the renewal date.

• –The price displayed on the App Store purchase screen applies
• –Payment is charged through your Apple ID and the App Store
• –Pricing and availability may vary by region
• –You can manage or cancel your subscription in iPhone Settings → your name (Apple ID) → Subscriptions
• –Cancellation takes effect at the end of the current billing period — it is not immediate
• –We cannot make subscription changes or cancellations on your behalf

A free trial period may be available for eligible users. Please check the App Store purchase screen for availability, duration, and terms. We do not guarantee that a free trial will be available to all users.

If you do not cancel before the end of the free trial period, your subscription will automatically convert to a paid plan.

STASH Pro purchases are processed by Apple through the App Store and StoreKit 2. Please check the App Store for the current price. Taxes and currency conversions are handled by Apple. We do not have access to your Apple ID or payment information.

To cancel STASH Pro, go to iPhone Settings → your name (Apple ID) → Subscriptions. Canceling at least 24 hours before the renewal date will stop the subscription from renewing for the next period. After cancellation, you can continue to use STASH Pro until the end of the current billing period.

Refund eligibility and procedures are determined by Apple's policies. To request a refund, please use Apple's official support channels. Sending an email to us does not constitute a refund request, and we do not process refunds directly.

Videos recorded in STASH are saved to your device and photo library. We do not transmit this data to our own servers and cannot view, modify, or restore data stored on your device. If data is lost due to app deletion, device reset, or other causes, we cannot restore it.

All intellectual property rights in the App belong to the developer or their respective rights holders. These Terms grant you a license to use the App within the scope of these Terms only, and do not transfer any other rights.

We may update the App's content without prior notice, except where required by applicable law. Some features may change or become unavailable due to OS, App Store, or Apple platform updates. We may temporarily suspend the App for maintenance, outage response, or security purposes.

We do not guarantee continued availability of the App. If the App is discontinued, we do not guarantee data migration or restoration. We will comply with applicable legal obligations and will not unfairly prejudice the rights of users who have made purchases.

The App uses services provided by Apple, including the App Store and StoreKit 2. Apple's terms of service and privacy policy govern those services. We are not responsible for the content, availability, or changes to Apple's services.

The App is provided "as is" and "as available." To the extent permitted by applicable law, we do not warrant:

• –The accuracy, completeness, usefulness, or fitness for a particular purpose of the App
• –Continuous, uninterrupted operation, or that the App will be error-free
• –That the App will work on all iPhone models, iOS versions, regions, or configurations
• –That pose detection will always function accurately
• –That recorded videos will always be saved successfully
• –That purchase restoration will always succeed

Except in cases of our willful misconduct or gross negligence, to the extent permitted by applicable law, we are not liable for indirect, special, incidental, consequential, or punitive damages, lost profits, or data loss.

To the extent permitted by law, our total liability to you shall not exceed the amount you actually paid for the App. This limitation does not apply where it is not permitted under applicable law.

Nothing in these Terms limits liability that cannot be excluded or limited under mandatory consumer protection laws, including the Japanese Consumer Contract Act.

If we make changes to these Terms, we will post the updated version on this page. The updated Terms take effect when posted. Your continued use of the App after changes are posted constitutes your acceptance.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full effect.

Our failure to enforce any provision of these Terms at any time does not constitute a waiver of that provision.

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may transfer our rights and obligations in connection with a merger, acquisition, or similar transaction.

These Terms are governed by the laws of Japan. To the extent permitted by applicable law, disputes arising from these Terms shall be subject to the exclusive jurisdiction of the Tokyo District Court or Tokyo Summary Court as the court of first instance. This does not limit any mandatory consumer protection rights you may have under the laws of your place of residence.
